Jon Vasey and Josh Strief Obtain Pre-Answer Dismissal of Lawsuit

Jon Vasey and Josh Strief successfully defended three clients by obtaining a pre-answer dismissal of Plaintiff’s lawsuit. Plaintiff filed a personal injury lawsuit arising out of a July 2019 vehicle accident. Mr. Vasey and Mr. Strief filed a pre-answer motion to dismiss, arguing Plaintiff failed to properly serve the Defendants. Plaintiff then quickly served at least one of the Defendants. However, Mr. Vasey and Mr. Strief prevailed as the Iowa District Court for Marshall County dismissed Plaintiff’s lawsuit. Because the case was dismissed and the statute of limitations has passed, Plaintiff is now unable to refile his personal injury lawsuit against Mr. Vasey’s and Mr. Strief’s clients.
