Josh Strief Obtains Defense Ruling in Polk County Bench Trial

Following a November 2018 bench trial before the Polk County District Court, Josh Strief obtained a defense ruling dismissing a Plaintiff’s case against his client.
The lawsuit arose from a 2017 vehicle accident where an oncoming vehicle crossed the center line in front of Mr. Strief’s client, who was forced to swerve to avoid a head-on collision and hit a parked vehicle. The owner of the parked vehicle sued, claiming Mr. Strief’s client was responsible for his property damage. At trial, Mr. Strief was able to successfully assert the sudden emergency defense, and the Court found his client was not negligent at the time of the vehicle accident.
