Spencer Vasey Dirth Successfully Defends Jury Trial Victory in Iowa Court of Appeals
Attorney, Spencer Vasey Dirth, successfully defended a 2022 jury trial victory in the Iowa Court of Appeals last week. The trial, a personal injury trial in which Ms. Dirth's client stipulated to fault, resulted in a complete defense verdict, with the jury finding Ms. Dirth's client had caused no damage to the Plaintiff. After entry of the verdict, the Plaintiff appealed to the Iowa Court of Appeals. The Plaintiff's appeal alleged the trial court judge had erred in granting the Defense's Motion in Limine prohibiting lay opinion testimony on causation.
The parties submitted briefing to the Iowa Court of Appeals and, on March 6, 2024, the Iowa Court of Appeals issued an opinion affirming the trial court's ruling and the verdict for the Defendant. Though many grounds for affirmance were forwarded by Ms. Dirth, the Court of Appeals premised its opinion on the first argument made by Ms. Dirth, that the Plaintiff had failed to preserve error on the Motion in Limine Ruling.
